Abstract
The document provides a thorough explanation of how Indian courts operate in money
laundering matters. The Indian Legislature passed a special law to address the problem in
2002, but its implementation contained a number of flaws. Then, after realising the dire need,
a modification was put into effect. The mechanism outlined in the PML Act is thoroughly
explained in the accompanying paper, which also shows how the courts function during
offence trials and while granting or denying bail. The author makes an effort to educate
readers about whether the proposed change is adequate on its own and how reluctant judges
and court presiding officers are to release offenders on bail under such a deterrent special
statute.
