Abstract

In this method, the patent rights based on artificial intelligence in the world were investigated in a descriptive-analytical way. In the current era, artificial intelligence has entered the field of inventions along with various industries and has created an important challenge in this branch of intellectual property rights. Intelligent systems have been able to create inventions, which is one of the challenging areas in intellectual property rights. The challenge here is who are the right holders of the hypothetical legal personality of artificial intelligence or other options that may be relevant in this regard. At first, this article takes a general look at the subject of artificial intelligence and machine learning and how these intelligent systems work, and then points to the functioning of this system in legal issues. Then it specifically deals with artificial intelligence in intellectual property, inventions resulting from intelligent systems and determining the inventor and patent owner based on different theories.
