Due to new legal texts established and difficult rulings handed down in nations like the United
States and India, the subject of abortion has recently generated a lot of controversy and debate.
These laws and rulings frequently restrict women's access to safe abortions and healthcare, as
well as their ability to make reproductive decisions. Whether an unwed mother has the right to
end a pregnancy at any time or whether an unborn child has the right to life is a contentious
issue. This research paper's goal is to look at the current state of abortion laws in India and the
United States and how they frequently infringe on human rights. Additionally, it will be
addressed whether the foetus or the pregnant woman has a higher right to life. Investigations
would also be conducted into judicial decisions concerning constitutional requirements and
abortion law. As a result, the research paper would show how human rights legislation and
abortion regulations are similar to one another and how one influences the other.
